Holland Conservation Commission

Minutes of Commission meeting held on June 12, 2012.

Present: Nathan Gumlaw, Chairperson, Neal Byrne, Patricia Caron, Mary Lovett, Marianne Martone and James Wettlaufer.
Absent: Marcia Beal.

Chairperson called the meeting to order.  The minutes of May 22, 2012 were read and accepted and will be distributed.

Mail:
We received a check from Jalbert Engineering paying the filing fee for a Notice of Intent for Carlo J. DiLizia of 25 Candlewood Dr. to renovate a single family residence.
The Public Hearing is scheduled for June 26, 2012 at 7:30 p.m.

We received a letter from David Cawley of 6 Stony Hill Rd. concerning the actions of Edward Dailey of 2 Sandy Beach Rd.  A copy of the letter was sent to the appropriate Boards.

We received from Richard Polverari of 7 Sunset Lane, DEP File #184-0261 a Request for Certificate of Compliance.  A site visit will be done.

Members signed the Order of Conditions for DEP File #184-0277 assigned to Brian Johnson, Highway Supervisor to install a slip line in a damaged culvert on Amber Brook near 171 Mashapaug Rd.

7:40 p.m.  Donald and Robin Wilson who recently purchased property at 57 Mashapaug Rd. near Stevens Brook spoke of their proposed alteration to their house.  They were instructed to see Jack Keogh, Building Inspector, who would give them a Procedure Sheet which would guide them to the various Boards required to complete their project.  We gave them forms enabling them to complete a Notice of Intent which is required due to their proximity to Stevens Brook.

7:55 p.m.  Donna Burns spoke in behalf of 2 elderly neighbors, Mona Duquette and Father Duquette regarding the placement of a dock in a right-of-way by a neighbor who lives across the street.  Although sympathetic to her cause, the Town does not have jurisdiction in this matter.  We recommended that neighbors hire an attorney with Title and Deeds background to handle this civil matter.

8:10 p.m.  Chris Wszolek of 95 Mashapaug Rd., Roy Walker of 61 Mashapaug Rd. and Sparky Lamontagne of Sandy Beach Rd., concerned neighbors of the shallowness, muck and weeds of Maybrook Cove gave us a publication titled Hydro Logic Products which is a pond and lake Aeration Systems that would help alleviate some of these conditions.  Although excited with the prospect of helping with these conditions, we told them that Mark Stinson, Circuit Rider of the DEP would be called to clarify what type of permit would be required to undertake such a project.

8:30 p.m.  Kathleen Hunt, Michael Ford of 225 Mashapaug Rd., Tracy Libretto of 221 Mashapaug Rd. and Leslie A. Duthie, Botanist Consultant, came in response to the Enforcement Order directive.  Leslie A. Duthie gave us each a narrative and pictures of the existing situation and their proposed restoration plans.  Leslie Duthie stated that a maintenance plan needs to be implemented that all work is to be done by hand, that all sand and silt, but no gravel at the base or the removal of native material, will be transported to an appropriate upland site on the property where herbaceous conservation mix will be applied.  The Commission accepted their restoration plan and are allowing them to start the restoration.  They will submit a Notice of Intent with a maintenance plan, completed by July 10th.  Tracy Libretto requested that all abutters within 100 feet of her property be informed of the Enforcement Order and that the right-of-way is not to be used for a dumping site.  A letter will be formulated and sent.

9:30 p.m. Mark Farrell of Green Hill Engineering gave us a check paying the filing fee for a Notice of Intent for Milton and Patricia Natusch of 19 Lakeridge Dr. to repair a septic system.  The scheduled Public Hearing is for June 26, 2012 at 8:00 p.m.

9:45 p.m.  Joel Jette, builder, inquired whether we would have a problem with the installation of a gazebo for Robert Muscaro of 171 Mashapaug Rd.  No digging would be done; only crushed stone would be placed under the gazebo.   We approved the project.

The meeting was adjourned at 9:55 p.m.
